Vitola — Terms of Use (End User License Agreement)

This End User License Agreement (“Terms” or “EULA”) is a binding agreement between you and the operator of Vitola (the “app”). By downloading, accessing or using the app you accept these Terms. Apple requires an EULA for apps that offer auto-renewing subscriptions and that host user-generated content; these Terms serve that purpose. If you do not agree, do not use the app.

1. Eligibility — adults only

Vitola is a reference, tasting-journal and pairing companion for adults who already enjoy cigars and their spirit/coffee companions. You must be at least 21 years old, and the app requires you to attest that you are 21 or older before use. You may not use the app on behalf of anyone under that age.

2. What Vitola is — and is not

Vitola helps you catalogue, journal and pair items you already own. It does not sell, ship, or facilitate the purchase of tobacco, alcohol or any other product, and it contains no store or checkout. Nothing in the app is an invitation or encouragement to start consuming, or to increase consumption of, tobacco or alcohol, and the app makes no health claims. Content is provided for adults who have already chosen to partake, to be enjoyed in moderation.

3. Licence

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use, subject to these Terms and to the Apple / Google store terms.

4. User-generated content and acceptable use

You are responsible for content you submit (reviews, notes, photos). By posting you grant us a licence to store and display that content within the app.

Zero tolerance for objectionable content and abusive behaviour. You may not post content that is hateful, harassing, threatening, sexually explicit, illegal, or otherwise objectionable, and you may not abuse other users. This mirrors the in-app community guidelines you accept before posting a review.

To keep the community safe we provide report and block tools, apply automated moderation on submission, and operate a moderation queue. Objecting content and the users responsible are removed within 24 hours of a report, and we may suspend or ban accounts that violate these Terms. Banned users may not post.

6. AI Sommelier — disclaimer

The AI Sommelier is optional and requires your explicit consent before first use (you can revoke it in Settings). Its responses are generated by a third-party AI provider (Google Gemini) and are provided for informational and entertainment purposes only. They are not medical, health, safety, legal or other professional advice, may be inaccurate or incomplete, and should be independently verified. The feature is for adults 21+.

7. Disclaimer of warranties

The app is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error-free or secure.

8. Limitation of liability

To the maximum extent permitted by law, the operator will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, arising from your use of the app. Our total liability is limited to the amount you paid for the app in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Termination

You may terminate at any time by deleting your account in Settings (a real, permanent server-side deletion). We may suspend or terminate your access for breach of these Terms, including the acceptable-use rules in §4.

10. Changes, governing law, contact

We may update these Terms; material changes will be reflected in the “Last updated” date. These Terms are governed by the laws of Türkiye (the operator is an individual developer based in Istanbul, Türkiye), without prejudice to mandatory consumer-protection rights in your country of residence.

For Apple-distributed builds, the standard Apple Licensed Application EULA also applies; where it conflicts with these Terms, the stricter user-protective term controls.
